NOTICE TO INTENT TO REQUEST RELEASE OF FUNDS

TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS:
On or about August 18, 2022, or eight (8) days after publication of this notice, the Town of Troy,
NC, will request the North Carolina Department of Commence (DOC) Rural Economic Development
Division (REDD) to release Federal Community Development Block Grant (CDBG) funds under Title I of
the Housing and Community Development Act of 1974 (PL 93-383), as amended, for the Town of Troy FY
18/19 CDBG Neighborhood Revitalization Housing Project. The project is funded with approximately
$750,000 of CDBG funds (100% of total project cost).
The proposed project includes the demolition and reconstruction of approximately four sub-standard
homes, owned and occupied by local low-to-moderate income (LMI) residents. All four homes require
extensive repairs that would be cost more than half the value of the home. Each home will be
rebuilt on the same site. Homes are located on North Carolina on Barnhill, Faduma, Rush, and
Williams streets. The activities proposed are categorically excluded under U.S. Department of
Housing and Urban Development (HUD) regulations at 24 CFR Part 58 from National Environmental
Policy Act (NEPA) requirements.
PUBLIC COMMENTS
An Environmental Review Record (ERR) documenting the environmental determinations for this project
is on file at the above address and is available for public examination and copying upon between
the hours of 9 AM and 4 PM Monday – Friday. All interested agencies, groups, and persons are
invited to submit written comments for consideration by the Town to the above address on or before
August 17, 2022, or seven (7) days after this publication. All such comments so received will be
considered by the Town prior to authorizing submission of a Request for Release of Funds.
ENVIRONMENTAL CERTIFICATION
The Town certifies to REDD that Mayor Craig Jones, in their official capacity, consents to accept
the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in
relation to the environmental review process and that these responsibilities have been satisfied.
The legal effect of the certification is that upon its approval, the Town may use the CDBG Program
funds and REDD will have satisfied its responsibilities under NEPA and related laws and
authorities.
OBJECTIONS TO STATE RELEASE OF FUNDS
REDD will accept an objection to its approval and release of funds and the Town’s certification
until September 2, 2022, or for a period of fifteen (15) days following the anticipated submission
date, or its actual receipt of the request (whichever is later) only if it is on one of the
following bases: (a) the certification was not executed by the Town’s Certifying Officer; (b) the
Town omitted a step or failed to make a decision or finding required by HUD regulations; (c) the
grant recipient or other participants in the development process have committed funds, incurred
costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of release of
funds by REDD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a
written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedures (24 CFR 58.76)
and shall be addressed to Valerie Moore Fegans, CDBG Director at REDD, 4346 Mail Service Center

REDD to verify the actual last day of the objection period.
